We provide small and medium size businesses/employers with dispute resolution, counseling and advice in labor and employment law and business issues. We act, in effect, as the human resources and in-house counsel for small and medium size businesses/employers.

Labor and Employment Law

  • Represent employers in Federal and State Courts, administrative agencies such as the Equal Employment Opportunity Commissions (EEOC) and the Division of Human Rights, mediation's, and arbitrations.
  • Represent and guide employers through governmental agencies (such as Department of Labor, Unemployment Board) audits.
  • Draft employment-related agreements such as offer letters, employment contracts and severance agreements.
  • Draft and implement employee handbooks, policies and procedures.
  • Draft and enforce post-employment restrictive covenants such as non-compete and non-solicitation agreements.
  • Compliance with laws prohibiting harassment and discrimination and defense of such claims.
  • Wage and hour compliance under the Fair Labor Standards Act (FLSA) and New York Labor Law and related litigation.
  • Compliance with a diverse array of complex workplace statutes and regulations such as the employment anti-retaliation provision of the Sarbanes-Oxley Act and Dodd-Frank Act, Family Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADA).
  • Advise employers on discipline and termination issues.
  • Provide training on employment law topics such as harassment and discrimination avoidance and documenting and imposing disciplinary action.
  • Labor union negotiations and prevention.

Business and Commercial Disputes and Litigation

  • Represent businesses in courts in pursue of and in defense of breach of contracts.
  • Resolve and negotiate resolutions for business disputes prior to court actions.
  • Represent clients in shareholder and ownership disputes for privately held corporations, including those involving shareholder derivative lawsuits.
  • Draft, edit and negotiate contracts.
